Court Refers Challenges on Constituent Assembly To Supreme Court

 Egypt’s Administrative Judiciary Court, First Circuit, headed by Judge Fareed Nazeeh- Deputy Chairman of State Council, referred the challenges against the constituent assembly to draft constitution to the Supreme Constitutional Court, to dispose of the resolution.

On April 10th 2012, the court nullified the first constituent assembly because it included a number of Upper and Lower Houses’ members. The court elaborated that this violates the Article 60 of the constitutional declaration, which provides for not participating any members of parliament in the constituent assembly to draw up the new constitution.

The second constituent assembly formation also embraced members of the dissolved parliament, but for their partisan capacity not the parliamentary ones.
